Good Policies Pay You Back    

Mary worked for a counselling agency for seven years. She was then laid off due to funding cutbacks and paid ten weeks termination pay. Mary sued her former employer and the court awarded her eight months pay in lieu of sufficient notice. The employer had to pay Mary the difference of thousands of dollars.

Would a good policy have prevented this lawsuit? Absolutely. The court in Mary's case looked at the employee manual of the counselling agency. The court found the agency had never gone over the manual with Mary and that the termination provisions of the manual, "could have been understood at least four different ways."

The learning points from this court case:

  • Write clear policies. Get help from a professional communicator.
  • Communicate policies. Show them to your workers and ensure understanding. 
  • Document your efforts. Obtain a signature.
